Terms of service.

These Terms of Service ("Terms") are a binding agreement between you and All Pro Pressure Washing & Handyman ("All Pro", "we", "us", or "our"). By using this website, requesting a quote, or accepting services from us, you agree to these Terms. If you do not agree, please do not use the site or our services. You must be at least 18 years old and legally able to enter into a contract to use this site or hire us.

All Pro Pressure Washing & Handyman provides residential and light commercial pressure washing, painting, carpentry, decks and fences, flooring, door and window installs, and cosmetic remodels in Kent County, Delaware. The specific scope of any job is described in the written quote or work order we provide to you.

Out-of-scope trades. Delaware requires a separate state license for electrical work (24 Del. C. Ch. 14), plumbing including faucet, toilet and water-heater installs (24 Del. C. § 1807), HVAC and refrigeration (24 Del. C. § 1820), gas piping, asbestos disturbance (16 Del. C. Ch. 78), and lead-paint disturbance in pre-1978 homes above EPA RRP thresholds (40 CFR Part 745). All Pro does not perform those trades. When a job requires them, they are performed only by appropriately licensed Delaware subcontractors engaged for that scope. This applies on every project, regardless of dollar value, and no contract with us purports to authorize otherwise. See the Licensing & Scope page for the full list.

Quotes are based on the information, measurements, and photos you provide and are valid for thirty (30) days unless stated otherwise. The final price may be adjusted on site if the actual scope, condition, or access materially differs from what was described. We will discuss and obtain your approval before continuing with any change in scope or price.

We schedule jobs on a first-come, first-served basis. Weather, safety, and access issues may require rescheduling at our discretion; we will work with you to find the next available slot. Please give us at least 24 hours' notice if you need to cancel or move an appointment. We reserve the right to charge a reasonable trip fee for same-day cancellations or for jobs we cannot complete due to undisclosed conditions on site.

Before service, you agree to:

• Provide safe, lawful access to the work area, including water and electrical connections when needed.
• Move vehicles, pets, and fragile items away from the work area.
• Close windows and doors, and cover or remove items that should not get wet or dusty.
• Disclose in advance any delicate plants, low-voltage lighting, satellite dishes, water features, security cameras, well caps, septic components, painted surfaces in poor condition, loose siding, rotten wood, lead paint (pre-1978 homes), asbestos, or other conditions that need special handling.
• Confirm that you are the owner of the property or are authorized by the owner to have the work performed.

We are not liable for damage caused by undisclosed conditions, pre-existing issues, or items left in the work area. Pressure washing and handyman work involve inherent risks (water intrusion through gaps, surface wear, etc.) which you accept by hiring us.

Final invoices are issued through HouseCall Pro and are due upon completion unless otherwise agreed in writing. We accept cash, check, credit/debit card, Cash App, PayPal, and Venmo. Larger or material-heavy jobs may require a deposit. Past-due balances may accrue a late fee of the lesser of 1.5% per month or the maximum permitted by Delaware law. You agree to reimburse reasonable collection costs and attorneys' fees we incur to collect amounts properly owed. Returned-check and chargeback fees may apply.

We stand behind our work. If something isn't right, notify us within thirty (30) days of completion and we will return and address it at no extra labor charge. This guarantee covers our workmanship only. It does not cover damage caused by misuse, abuse, weather events, normal wear, the age or condition of the surface, work performed by others, or materials supplied by the customer. Some manufacturer warranties on materials we install may pass through to you; ask us for details.

All Pro Pressure Washing & Handyman holds a Delaware Business License (#2025712562) issued by the Delaware Division of Revenue and carries general liability insurance appropriate to the services we provide. Proof of license and insurance is available on request.

All Pro is not registered with the Delaware Department of Labor as a construction contractor under 19 Del. C. Ch. 36, and is not a licensed electrical, plumbing, HVAC/refrigeration, gas, asbestos, or lead-abatement contractor in the State of Delaware. Delaware law requires construction-contractor registration for any contractor performing $50,000 or more of work in a calendar year (19 Del. C. § 3606). For that reason, All Pro caps the total contract value of any single residential project at $50,000. We will not enter into a single contract above that amount, and we will not split, phase, sequence, or otherwise restructure a larger job into multiple contracts in order to evade that threshold. If your project exceeds the cap, we will tell you up front and refer the over-cap scope to an appropriately registered Delaware general contractor.

Any scope falling within a Delaware licensed trade is performed only by appropriately licensed Delaware subcontractors engaged for that scope, regardless of project size. Required local building, electrical, plumbing or mechanical permits are pulled by the appropriately licensed party for the relevant scope.

Per 6 Del. Admin. Code § 106-3.0, any home-improvement contract we enter into with you will include a written scope of work, an itemized price, an approximate completion date, and our full contact information.

If the contract is solicited at your home (an in-home sale), Delaware law (6 Del. C. § 4404(2)) gives you the right to cancel the contract until midnight of the third business day after you sign it. To cancel, send written notice of cancellation to the address on the contract or to louiemoctezuma16@gmail.com within that window; you are entitled to a refund of any deposit paid, less the cost of any goods you have agreed to keep.

We may take before-and-after photos of the work for our portfolio, website, and social media. We will not include personally identifying details such as house numbers, license plates, or interior valuables without your permission. Please tell us in writing if you would prefer we not use photos of your property.

The website and its content are provided "as is" and "as available"without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components.

To the fullest extent allowed by law, our total cumulative liability for any claim arising out of or relating to a job is limited to the amount you actually paid us for that specific job. We are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of use, even if we have been advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law (such as gross negligence or willful misconduct).

You agree to indemnify and hold harmless All Pro Pressure Washing & Handyman and its owners, employees, and contractors from claims, damages, and reasonable expenses arising out of (a) your breach of these Terms, (b) your misrepresentation of site conditions or authority over the property, or (c) your violation of any law or the rights of a third party.

The content on this site, including text, photos, graphics, logos, and design, is owned by All Pro Pressure Washing & Handymanor its licensors and is protected by U.S. copyright and trademark law. You may view and print pages for your personal, non-commercial use. You may not copy, modify, distribute, scrape, or use our content for commercial purposes without our written permission. All third-party trademarks belong to their respective owners.

You agree not to:

• Use this site for any unlawful purpose or to harass, defraud, or harm others.
• Attempt to access non-public areas of the site, probe for vulnerabilities, or interfere with security.
• Submit false, misleading, or third-party personal information through our forms.
• Use automated systems (bots, scrapers, crawlers) to access the site, except for well-behaved search engine crawlers.

This site may link to third-party services (such as scheduling, payment, and review platforms). We are not responsible for, and do not endorse, the content, policies, or practices of those third parties. Your use of them is governed by their own terms.

This website is built and maintained for All Pro Pressure Washing & Handyman by our website and marketing provider, which also handles quote form delivery, website measurement, and our search listings on our behalf. All services described on this site are contracted with, performed by, and invoiced by All Pro Pressure Washing & Handyman; our website and marketing provider does not perform the work and is not a party to your service agreement.

The site uses Google Analytics 4 and the Google Ads tag to measure traffic and form submissions, and Cloudflare Turnstile plus automated spam screening on our forms. By submitting a form, you accept those checks and understand a submission that is screened as automated or abusive may not be delivered. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Subject to the dispute-resolution section below, you and All Pro Pressure Washing & Handyman agree that any dispute will be heard exclusively in the state or federal courts located in Kent County, Delaware, and you consent to the jurisdiction of those courts.

Before filing a formal claim, you agree to first contact us at (302) 228-2470 and give us a reasonable opportunity (at least 30 days) to resolve the issue informally. If we cannot resolve it, either party may pursue the claim in the courts identified above. Claims must be brought within one (1) year after the basis for the claim first arose, except where a longer period is required by applicable law. Each party waives any right to a jury trial to the fullest extent permitted by law.

If any part of these Terms is held unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy and any signed quote or work order, are the entire agreement between you and All Pro Pressure Washing & Handyman regarding your use of this site and our services, and supersede prior understandings on those topics.

We may update these Terms from time to time. The "Last updated" date at the top will always reflect the most recent version. Continued use of the site or our services after changes take effect means you accept the updated Terms.
